A Sprint spokeswoman said that the carrier did experience some “mild call blocking” immediately following the blasts [in Boston] due to above normal traffic, but that otherwise the network was operating normally.

What a bunch of baloney! This sounds like a typical marketing-person's response: “mild call blocking.” The truth is, when you need your cellphone the most, it won't work. When everyone is trying to talk at the same time, any shared-resource system will be overloaded (or choked) and will not work. To make matters worse, when a call is blocked by a busy system, a user will typically retry immediately—making the situation much worse. Microsoft Gives Smartwatches Another Try

Remember SPOT? While it may have gone the way of the Zune, Microsoft appears to be readying another smartwatch as rivals eye the burgeoning market.

Pebble, one of biggest crowd-funding successes on Kickstarter, helped catapult wearable IT back into the limelight last year. Now, Microsoft is reportedly eyeing a smartwatch of its own.

The e-paper-based, Bluetooth-enabled Pebble smartwatch, which can link with iPhone and Android handsets, hauled in over $10 million by its May 18, 2012, deadline. Among its many uses, the customizable device can be used to display incoming messages and emails, control music, log distance and speed and, of course, tell time.

Nearly 69,000 backers pledged at least $1 dollar—although the bulk contributed $125 or more—to Palo Alto, Calif.-based Pebble Technology, indicating that there is a ready, perhaps robust, market for the technology. Although its first stab at smartwatches never quite caught on with consumers, Microsoft is at least exploring the possibility of re-entering the market and capitalizing on the growing popularity of wearable tech, according to an April 15 report in The Wall Street Journal.

Sources told the news organization that Microsoft has approached component makers and requested 1.5-inch displays for a touch-capable smartwatch. The report indicates that while a new smartwatch from Redmond isn't necessarily a sure thing—Microsoft is staying mum on the subject—the project has progressed far enough to warrant some earnest engagement with electronics suppliers.

"One executive said he met with Microsoft's research and development team at the software company's Redmond, Wash., headquarters. But it's unclear whether Microsoft will opt to move ahead with the watch, they said," according to the Journal.

The news follows persistent industry rumblings about Apple's interest in creating an "iWatch." Apple, in collaboration with Intel, is reportedly prepping a smartwatch with a 1.5-inch OLED display that can interact with devices like the iPhone and iPad. According to TGbus.com, the watch will feature Bluetooth connectivity—perhaps be Bluetooth 4.0 complaint, with support for the Bluetooth low-energy (BLE) spec—and indium tin oxide- (ITO-) coated glass from RiTdisplay, a Taiwanese panel maker.

Other device makers are joining the smartwatch craze, including Samsung. On March 19 it was revealed that the South Korean consumer electronics giant was working on a similar device. Google and LG are also expected to follow suit. Sony already has an Android-powered, OLED touch-screen model on the market, called SmartWatch, appropriately enough.

While Microsoft may appear to be a latecomer to the wearable technology race, the tech titan has a long, if uncelebrated, history with smartwatches.

A decade ago, the company first showed off smartwatches based on its Smart Personal Object Technology (SPOT), which delivered personalized content over FM-radio frequencies via a service called MSN Direct. Considered one of Microsoft's most notable flops, the service was eventually shuttered in 2012.

USA Mobility Reports Fourth Quarter and 2012 Results; 2011 Financial Restatement Completed

Wireless Subscriber and Revenue Trends Show Solid Improvement As Operating Margins Remain Strong and Expenses Decline; Software Bookings and Backlog Reach All-Time High

SPRINGFIELD, Va.—(BUSINESS WIRE)—Apr. 15, 2013— USA Mobility, Inc. (Nasdaq: USMO), a leading provider of wireless messaging , mobile voice and data and unified communications solutions , today announced final operating results for the fourth quarter and year-ended December 31, 2012. The Company had previously reported selected results for the fourth quarter and 2012 pending completion of its year-end financial audit and restatement of its 2011 financial statements due to a material weakness in the design of internal control over financial reporting in its software revenue recognition processes. Results below reflect completion of the 2012 audit and restatement of 2011 financial statements. There was no material impact to the previously reported interim periods of 2012.

For the fourth quarter, consolidated revenue was $51.9 million, compared to $57.8 million in the fourth quarter of 2011 and $55.1 million in the third quarter of 2012. Revenue from the Company's Wireless business (USA Mobility Wireless) was $39.9 million in the fourth quarter, compared to $46.5 million in the fourth quarter of 2011 and $41.4 million in the third quarter of 2012. Revenue from the Software business (Amcom Software) was $12.0 million in the fourth quarter, compared to $11.2 million in the year-earlier quarter and $13.7 million in the third quarter of 2012. USA Mobility acquired Amcom Software on March 3, 2011.

Fourth quarter EBITDA (earnings before interest, taxes, depreciation, amortization, accretion and impairment) was $12.4 million, or 23.9 percent of revenue, compared to $17.4 million, or 30.1 percent or revenue, in the fourth quarter of 2011 and $17.8 million, or 32.2 percent of revenue, in the third quarter of 2012.

Net income for the fourth quarter of 2012 was $2.0 million, or $0.09 per fully diluted share, compared to $17.9 million, or $0.79 per fully diluted share, in the year-earlier quarter and $8.0 million, or $0.36 per fully diluted share, in the third quarter of 2012. The increase in net income in the fourth quarter of 2011 was largely the result of a benefit to income tax expense of $10.7 million due to a decrease in the deferred income tax asset valuation allowance which adjusted the balance of deferred income tax assets to their estimated realizable amounts. Excluding the income tax benefit and purchase accounting adjustments, net income for the fourth quarter of 2011 would have been $7.8 million, or $0.35 per fully diluted share.

For the full-year 2012, consolidated revenue was $219.7 million, compared to $233.7 million in 2011. Of the total, Wireless revenue was $168.4 million and Software revenue was $51.3 million, compared to $199.7 million and $34.0 million, respectively, for 2011.

EBITDA for 2012 was $67.3 million, or 30.7 percent of revenue, compared to $71.2 million, or 30.5 percent of revenue, for 2011. Excluding a fair value write down of software maintenance revenue of $6.1 million, EBITDA for 2011 would have been $77.2 million, or 32.2 percent of revenue.

Net income for 2012 was $27.0 million, or $1.20 per fully diluted share, compared to a net income of $83.8 million, or $3.72 per fully diluted share, for 2011. Excluding purchase accounting adjustments and a tax benefit of $50.2 million due to a decrease in the deferred income tax asset valuation allowance, net income for 2011 would have been $37.2 million, or $1.65 per fully diluted share.

Key results and highlights for the fourth quarter and 2012 included:

Wireless

  • Fourth quarter EBITDA for Wireless was $14.0 million, or 35.0 percent of revenue, compared to $17.1 million, or 36.7 percent of revenue, in the fourth quarter of 2011 and $16.3 million, or 39.3 percent or revenue, in the third quarter of 2012. Excluding severance expenses, fourth quarter EBITDA margin would have been 37.9 percent, compared to 39.3 percent in the year earlier quarter. For 2012, EBITDA margin increased to an all-time high of 38.3 percent, compared to 37.2 percent in 2011.
  • Net unit losses were 31,000 in the fourth quarter, compared to 37,000 in the third quarter and 53,000 in the year-earlier quarter, while the quarterly rate of unit erosion improved to a historic low of 2.0 percent from 2.3 percent in the third quarter and 3.1 percent in the fourth quarter of 2011. The annual rate of unit erosion improved to 9.2 percent in the fourth quarter, also a record low, from 11.7 percent in the year-ago quarter. Units in service at December 31, 2012 totaled 1,515,000 compared to 1,668,000 at December 31, 2011.
  • The rate of Wireless revenue erosion in the fourth quarter was 3.7 percent, compared to 3.1 percent in the third quarter and 4.1 percent in the year-earlier quarter. The annual rate of total revenue erosion was 14.2 percent in the fourth quarter, compared to 14.6 percent in the third quarter and 14.8 percent in the year-earlier quarter. The year-over-year rate of paging revenue erosion improved to a record low 13.3 percent in 2012 from 14.6 percent in 2011.
  • Total ARPU (average revenue per unit) was $8.29 in the fourth quarter, compared to $8.36 in the third quarter and $8.51 in the fourth quarter of 2011. For the year, ARPU totaled $8.37, compared to $8.64 in 2011.

Software

  • Bookings for the fourth quarter increased to a record $18.1 million, compared to $15.7 million in the third quarter and $15.2 million in the year-earlier quarter. Bookings for the second half of the year increased to $33.8 million, compared to $27.5 million for the first half of 2012 representing an increase of 22.9%.
  • Backlog increased to an all-time high of $40.6 million at December 31, 2012, compared to $36.2 million at September 30, 2012, and $32.9 million at year-end 2011.
  • The renewal rate for maintenance in the fourth quarter was 99.7 percent.

Total Company

  • Operating expenses (excluding depreciation, amortization, accretion and impairment) totaled $39.5 million in the fourth quarter, with $26.0 million for Wireless and $13.5 million for Software, compared to operating expenses of $40.4 million in the year-earlier quarter, with $29.5 million for Wireless and $10.9 million for Software. For 2012, operating expenses were $152.4 million, including $103.9 million for Wireless and $48.5 million for Software, compared to $162.5 million in 2011, including $125.3 million for Wireless and $37.2 million for Software.
  • Capital expenses were $2.9 million in the fourth quarter, compared to $2.8 million in the year-earlier quarter. For 2012, capital expenses totaled $10 million, compared to $8 million in 2011.
  • Dividends paid to stockholders totaled $16.5 million in 2012.
  • The Company's cash balance was $61 million at December 31, 2012.
  • The number of full-time equivalent employees at December 31, 2012 totaled 665, including 378 for Wireless and 287 for Software, compared to a total of 683 at year-end 2011, including 434 for Wireless and 249 for Software.

"Despite the unfortunate delay in finalizing results, we were very pleased with our operating performance for the fourth quarter and full-year 2012," said Vincent D. Kelly, president and chief executive officer. "Once again we either met or exceeded our key performance targets as both our Wireless and Software businesses achieved record results for the fourth quarter in several key operating categories. Overall, we continued to operate the Company profitably, maintain high operating margins in our Wireless business, reduce expenses, enhance our products and services, and expand our Software business into new markets. We also generated sufficient cash to again return capital to stockholders in the form of dividends and share repurchases."

Kelly added: "Wireless subscriber and revenue trends improved substantially in the fourth quarter as the rates of unit and revenue erosion reached their best levels since USA Mobility was formed in 2004. Net subscriber churn declined to 9.2 percent from 11.7 percent in the year-earlier quarter while the year-over-year rate of paging revenue erosion fell to 13.3 percent from 14.6 percent in 2011. In addition, the EBITDA margin for Wireless increased to a record high of 38.3 percent in 2012 versus 37.2 percent in 2011 as the reduction of Wireless costs continued to outpace the decline of revenue. Our Wireless business expanded operating margins for the seventh consecutive year."

Healthcare continued to be the largest sector for the Company's Wireless business, representing 67.1 percent of the total Wireless customer base, compared to 62.6 percent a year ago. Healthcare also continued to be the best performing market segment with the highest rate of gross placements and lowest unit churn.

Kelly said the Company's Software subsidiary also recorded an excellent performance in 2012, especially over the second half of the year. "Software bookings (operations and maintenance) for the last six months of 2012 increased 22.9 percent over bookings in the first half of the year." The up-tick in second half results was due in part to several factors, Kelly noted, including a new senior management team, a restructured approach to sales and marketing, continued growth of Amcom Software's product development pipeline, and expansion into new geographic markets.

Kelly added: "Software bookings rose to a record high for the quarter and the backlog reached an all-time high at year end. Demand continued to be strongest in North American hospitals where we sold software solutions for call center management, emergency notification, clinical alerting, middleware and mobile communication solutions. In addition, we expanded our sales focus internationally, specifically in the Middle East where we opened an office in Dubai. We also experienced growing demand among public safety organizations with a number of military and municipal 911 emergency response centers choosing Amcom Software's dispatch solution. As a result, we ended the year with a solid pipeline of new business opportunities and believe our Software business established positive momentum entering 2013."

Kelly said USA Mobility returned $24.5 million in capital to stockholders during 2012 in the form of dividends and share repurchases. The Company paid quarterly cash dividends to stockholders totaling $16.5 million, or $0.75 per share, during 2012, and repurchased 712,173 shares of its common stock for approximately $8.0 million (excluding commissions) after renewal of the Company's stock repurchase program in July. "Over the past eight years we have now returned $405.3 million to our stockholders in the form of cash distributions and $59.8 million in common stock repurchases."

Shawn E. Endsley, chief financial officer, said: "Operating and EBITDA margins remained strong in 2012 as we continued to reduce operating expenses in our Wireless business. Consolidated operating expenses (excluding depreciation, amortization, accretion and impairment) for Wireless declined 17.1 percent to $103.9 million in 2012 from $125.3 million in 2011 and marked the seventh consecutive year in which Wireless expense reduction outpaced the annual rate of Wireless revenue erosion." Endsley added: "Expense reduction in the Wireless business was largely due to continued progress in our network rationalization program, including lower site rents and various other company-wide initiatives. As a result of these efforts, combined with solid cash flow from our Wireless and Software businesses, the Company was able to repay its bank debt during the second quarter of 2012 and end the year debt-free with a consolidated cash balance of $61 million."

Commenting on the Company's financial guidance for 2012, Endsley said: "We are pleased that once again results were consistent with our adjusted guidance. For 2012, total reported revenue of $219.7 million was within our guidance range of $215 million to $227 million, operating expenses (excluding depreciation, amortization, accretion and impairment) of $152.4 million were better than our guidance range of $154 million to $162 million, and capital expenses of $10.0 million were slightly above our guidance range of $7.1 million to $9.5 million." Endsley said the Company expects to provide financial guidance for 2013 when it releases its first quarter results next month.

The Company believes that the filing of its Form 10-K today cures the NASDAQ filing deficiency notice reported on April 5th and brings the Company back into compliance with the NASDAQ reporting requirements. The Company plans to host a conference call for investors after reporting first quarter results.

Bullet Hits Paging Device on Belt, Firefighter OK

A Berkeley firefighter responding to an medical emergency call early this morning, Monday, was saved by a communications device on his belt that was hit a bullet fired by an elderly man, according to police and news reports.

pager An 88-year-old man fired a gun during an emergency medical call at home near Dwight Way and San Pablo Avenue early this morning, striking a communications device worn by a Berkeley firefighter, according to police news reports.

The firefighter was treated at the scene in the 1200 block of Dwight Way and didn't require hospitalization, Berkeley Police Officer Jenn Coats told Patch.

"We are very grateful that the firefighter was not hurt more seriously," she said. The bullet struck a Swissphone paging device that he was wearing on his belt, she said.

He was "resting at home with his family," Coats said in an update late this afternoon.

The shooter was taken "taken into custody without further incident," Coats said. "He is currently at a local hospital being evaluated."

Coats said the fire department was responding to a medical call that came in at 1:41 a.m. and requested police assistance at the scene. Responding officers heard two shots fired inside the home, she said.

Police found several firearms in the residence, which PD did recover several firearms from the residence, which "were removed for safety reasons," Coats said.

A Berkeley firefighter narrowly escaped serious injury when he was shot at while responding to an emergency medical call at an elderly man's home early today, a fire department spokesman said.

Firefighters responded to a home in the 1200 block of Dwight Way at 1:41 a.m. after they received an automated medical alert indicating that someone at the residence was having an emergency, acting Deputy Fire Chief Avery Webb said.

Firefighters asked Berkeley police to respond as well because the house was locked, but while they were waiting for police to arrive, the elderly man who lives there fired a gun at them, striking one of the firefighters, Webb said.

However, the bullet hit the firefighter's Swissphone, which Webb said is a pager-like device firefighters wear around their belts to receive communications.

The device "no doubt saved the firefighter from having significant injuries or worse," Webb said.

The firefighter was treated at the scene and, at this point, doesn't appear to need further treatment, he said.

Webb said the elderly man who lives at the house was taken away in an ambulance.

Berkeley police spokeswoman Jennifer Coats wasn't immediately available for comment.

Webb said the firefighter who was shot and the other firefighters who responded to the emergency call were released from their duties for the rest of the day for "defusing," a department policy that allows them time to deal with the psychological effects of a traumatic situation.

He said Berkeley firefighters are used to responding to other types of emergencies such as burning buildings and natural gas leaks, "but most incidents don't include firearms and circumstances like this."

Law Introduced to Require Provision of Cell Call Location Data to Law Enforcement

Specifically, the legislation would amend Section 222 of the Telecommunications Act by adding new section 222A. Section 222A would state that, "...at the request of a law enforcement agency, a telecommunications carrier shall provide call location information concerning the user of a commercial mobile service ... or an IP-enabled voice service ... in order to respond to the user's call for emergency services or to respond to an emergency situation that involves the risk of death or serious physical harm."

According to Kansas State Senator Greg Smith (R), for whose daughter the law is named, "The current rules state that cell information may be released by cell phone companies under federal law, but they are not required. The Kelsey Smith Act says that if it is an emergency situation, if there is the danger of loss of life, if there's a situation where someone is in danger of serious bodily harm, then release the location information to law enforcement."

Kelsey Smith was abducted and murdered in June of 2007, and law enforcement officials were not able to find her body until her cell phone provider, Verizon Wireless, provided the location data for her cell phone. Although Verizon Wireless took four days to produce the records, FoxNews reported that Smith's parents acknowledged their daughter was likely killed by the time authorities were notified of her disappearance and that any information obtained by Verizon would not have changed that outcome.

FCC Sets May 13 Comment Date for 9-1-1 Reliability Rulemaking; Reply Comments Due May 28

Due in significant part to the planning and system failures of a certain large wireline and wireless carrier during and after the June 2012 Derecho storm that knocked out power and telecommunications services (including emergency 911 services) in the Washington, DC area and other portions of the Mid-Atlantic states, the FCC has initiated a rulemaking to improve the reliability of 911 service. The proposed improvements include: (a) regular auditing of the physical routes of 9-1-1 circuits; (b) maintenance of reliable and resilient back-up power for central offices; (c) provision of physically diverse monitoring and control links and capabilities throughout communications networks; and (d) improved procedures for notifying Public Safety Answering Points ("PSAPs") when outages are likely to affect 9-1-1 service. These may be enforced by some combination of minimum reliability standards and periodic reports, certifications, compliance reviews and/or site inspections. The proposed new rules and procedures would apply to all "9-1-1 service providers," which include all incumbent local exchange carriers ("ILECs") and other service providers that furnish 9-1-1 call routing, automatic location information, emergency services Internet Protocol networks ("ESInets"), and similar services directly to one or more PSAPs.

While no one questions the need for public safety and reliable 9-1-1 services, it is not clear why the problems predominately of one large carrier during a heretofore rare weather event require the imposition of extensive and costly new requirements upon thousands of service providers nationwide. This is particularly true for rural telephone companies, competitive local exchange carriers and small wireless carriers that are losing universal service and other regulated revenues not only during a time of recession but also during a time when broadband and other developing services require new investment. The FCC (and your Congressional delegations) need to be reminded that carriers cannot print their own money, and that they need to devote their increasingly limited finances to meeting the increasing service needs and demands of their customers rather than the constantly increasing regulatory and reporting requirements of the FCC.

Justice Department Urges FCC to Adopt Spectrum Policies that Improve Competitive Dynamic Among Carriers; Seeks to Protect "Small" Carriers Like T-Mobile and Sprint

The U.S. Justice Department Antitrust Division last week made an ex parte submission to the FCC in its mobile spectrum holdings docket (WT Docket No. 12-269) urging the Commission to adopt rules that ensure "smaller" nationwide carriers, such as T-Mobile and Sprint, have an opportunity to acquire spectrum in lower frequency bands (i.e., below 1 GHz). The filing makes no specific recommendation of auctioning spectrum in smaller geographic areas, but it recognizes that smaller carriers with low-frequency spectrum may offer alternatives that consumers value, such as "particularly strong coverage" in rural areas.

"The Department concludes that rules that ensure the smaller nationwide networks, which currently lack substantial low-frequency spectrum, have an opportunity to acquire such spectrum could improve the competitive dynamic among nationwide carriers and benefit consumers," the Justice Department said.

"Particularly if low-frequency spectrum remains scarce," the Department said, "the Commission must ensure that the allocation of spectrum at auction does not enable carriers with high market shares to foreclose smaller carriers from improving their customers' coverage."

The Comments cited to the Justice Department's role in helping to facilitate the transformation of the telecommunications industry over the last thirty years, as the agency that enforces the antitrust laws and indirectly in its role as competition policy advocate and statutory respondent in cases involving appeals of FCC orders under the Hobbs Act. This federal law prohibits actual, attempted or contemplated robbery or extortion affecting interstate or foreign commerce.

In 2011, after close coordination with the FCC, the Justice Department filed a lawsuit to block the merger of AT&T and T-Mobile USA, Inc., ultimately leading the parties to abandon the merger. In 2012, the Justice Department and FCC reviewed a transaction in which Verizon, the nation's largest wireless carrier, entered joint marketing agreements with and acquired spectrum from four of the nation's largest cable companies. In that transaction, the Justice Department obtained limitations on the scope and duration of Verizon's agreements with the cable companies to prevent competitive harm and allowed Verizon to acquire AWS spectrum only after Verizon had agreed to sell a significant portion of that spectrum to T-Mobile.

The mobile spectrum holdings NPRM, which was published in the Federal Register last fall, sought comments on assisting the FCC in a comprehensive review of its policies governing mobile spectrum holdings. The last comprehensive review of these policies was in 2003.

The Justice Department's ex parte filing highlights the importance of spectrum to competition and innovation in the wireless industry and the factors the Department considers to be important in assessing the competitive effects of transactions in wireless markets.

In discussing the assignment of spectrum to individual service providers, the Justice Department recognized that, in the absence of strong competitors, auctioning spectrum to the highest bidder may not always lead to the highest benefit to consumers. This is due to the high "foreclosure value" that incumbents put on preventing their rivals from obtaining spectrum and thereby improving their services. The Department believes that consideration of the role that "foreclosure value" might play in how spectrum is used is crucial because local mobile wireless markets across the nation are relatively concentrated.

The Justice Department also recognized that carriers will be most competitive if they have at least some low-frequency spectrum to provide a good coverage layer. The Department therefore believes it is important that the Commission devise policies that address the allocation of low-frequency spectrum so that acquisitions of such spectrum do not hamper the ability of carriers to compete in markets where that spectrum is important (i.e., rural areas).

While the Justice Department's filing arguably supports the case for small and rural service providers to have greater access to low-frequency spectrum, such as reclaimed TV-Band spectrum, it would seem to give more of a boost to the prospects of smaller nationwide carriers, Sprint and T-Mobile, and their ability to compete against Verizon Wireless and AT&T.

"The Commission's policies, particularly regarding auction of new low-frequency spectrum, can potentially improve the competitive landscape by preventing the leading carriers from foreclosing their rivals from access to low-frequency spectrum," said the Justice Department.

FCC Report Concludes Nationwide Emergency Alert System Architecture is "Basically Sound" but Some Glitches Remain

Eighteen months after the first-ever nationwide test of the Emergency Alert System, the FCC's Public Safety and Homeland Security Bureau (PSHSB) this week issued a report entitled "Strengthening the Emergency Alert System (EAS): Lessons Learned from the Nationwide EAS Test." The Report concludes that, despite some technical glitches, the EAS distribution architecture is basically sound and recommended a further rulemaking to examine equipment performance issues.

As our clients may be aware, the EAS is a national public warning system that requires broadcasters, cable television systems, wireless cable systems, satellite digital audio radio service (SDARS) providers, and direct broadcast satellite (DBS) providers to provide the communications capability to the President to address the American public during a national emergency. The system also may be used by state and local authorities to deliver important emergency information, such as AMBER alerts and weather information targeted to specific areas. EAS is jointly coordinated by the FCC, the Federal Emergency Management Agency ("FEMA") and the National Weather Service ("NWS"). EAS regulations and standards are governed by the PSHSB.

The FCC and FEMA conducted a nationwide test of the EAS on November 9, 2011, with thousands of broadcasters, cable operators, and other EAS Participants taking part. The test involved the simultaneous receipt and broadcast of a live national EAS alert to all EAS Participants across the United States and its territories. The purpose of the test was to allow the FCC and FEMA to assess how the national EAS architecture would perform in practice, and to develop and implement any necessary improvements to ensure that the EAS, if activated in a real emergency, would perform as designed.

The Bureau's report found that a large majority of the EAS Participants successfully received the Emergency Action Notification (EAN), the live code for the national EAS, and, if required, retransmitted the EAN to other EAS Participants. While the test demonstrated that the national EAS distribution architecture was basically sound, it also uncovered several problems that impeded the ability of some EAS Participants to receive and/or retransmit the EAN. These included:

  • Widespread poor audio quality nationwide;
  • Lack of a Primary Entry Point (PEP) in the area to provide a direct connection to FEMA;
  • Use of alternatives to PEP-based EAN distribution;
  • The inability of some EAS Participants either to receive or retransmit the EAN;
  • Short test length; and
  • Anomalies in EAS equipment programming and operation.

The Bureau recommends that another nationwide test take place after the FCC takes some steps to strengthen the EAS, including (1) commencing a rulemaking to examine equipment performance issues during the activation of an EAN; (2) encouraging states to review and as necessary update their EAS plans to ensure that they contain accurate and up-to-date information regarding monitoring assignments as required by FCC rules; (3) commencing a rulemaking to consider possible changes to its EAS plan rules; and (4) working with FEMA to develop and issue best practices and other educational materials for EAS Participants.

The Commercial Mobile Alert System (CMAS) is a similar emergency national and localized alerting network for mobile wireless service that allows for distribution of alerts originated by Federal, State, local and tribal officials; and the alerts are disseminated via the Integrated Public Alert and Warning System (IPAWS). Unlike EAS, where all subject service providers must participate, only wireless carriers that have elected to participate in the CMAS have an obligation to transmit emergency alerts to their subscribers or to participate in testing activities that may be scheduled from time to time.

Dish Network Makes Competing Offer to Buy SprintNextel

On Monday, Satellite TV giant Dish Network announced that it had submitted an unsolicited competing $25.5 billion offer for Sprint Nextel, the third largest wireless carrier behind Verizon Wireless and AT&T. The offer competes with the previous offer made by SoftBank, a Japanese telecommunications company.

Under the existing Softbank offer, Softbank had agreed to acquire 70 percent of SprintNextel in a transaction that was worth $20 billion. The offer from Dish Network is said to be worth $25.5 billion or $7.00 a share of which $4.76 is in cash per share with the remainder in DishNetwork stock. Overall, SprintNextel shareholders would receive 32% of Dish Network stock.

As the third largest wireless carrier, SprintNextel has 56 million subscribers and has faced a challenging time competing with Verizon and AT&T. The competition could become even fiercer for SprintNextel if Deutsche TeleKom is able to purchase MetroPCS. Dish Network believes that it will be able to combine its existing broadband and television offerings with Sprint Nextel's wireless telephone offerings – which would allow it to compete with other wireless carriers that are also expanding their service offerings.

The proposed Dish Network/SprintNextel deal is once again raising questions as to whether partnerships and mergers between major carriers are good for customers. While a merger involving SprintNextel may be beneficial from a business standpoint, there are concerns that large mergers may lead to fewer jobs, less competition and higher prices for consumers. Countering these concerns, Dish Network stated that 14 million Dish customers would get improved services on their cellphones. What remains to be seen is if a Dish Network/SprintNextel merger would be a game changer that makes SprintNextel a more viable competitor against Verizon Wireless and AT&T or whether SprintNextel continues to lag behind Verizon and AT&T.

Carriers Deny Cell Shutdown Following Boston Bombings

Wireless operators say they did not shut down cell service following the deadly bombings at the finish line of the Boston Marathon yesterday.

Amid the chaos and confusion immediately following the explosions, the Associated Press issued a report citing an unnamed source who claimed cell service had been terminated in the Boston area to prevent the remote detonation of more bombs from cell phones.

Verizon wireless and T-Mobile denied any interruption of service in the area, and the Associated Press later retracted the story.

"Verizon Wireless has not been asked by any government agency to turn down its wireless service. Any reports to that effect are inaccurate," a Verizon spokeswoman said in a statement.

AT&T also pointed out the Associated Press had retracted its report. The carrier issued the following statement:

"Our thoughts are with those affected by today's tragedy in Boston. We are working closely with local officials and we have set up a mobile calling center and phone charging station in the Sheraton Hotel," said an AT&T spokesman in an email. "In addition, our Wi-Fi network, turned up for the Boston Marathon is now available to customers of all wireless carriers and will remain on for an extended period of time."

Sprint also denied any shut down of service. A Sprint spokeswoman said that the carrier did experience some "mild call blocking" immediately following the blasts due to above normal traffic, but that otherwise the network was operating normally.

The Sprint spokeswoman said that when blocking occurs, customers can still make and receive calls, but it might take a second or third attempt for the call to go through.

"In cases like this, we recommend that customers text rather call," she said, noting that text messages transmit with very minimal to no delay, freeing up network capacity for law enforcement, first responders and emergency medical personnel.

Peter Svensson of the Associated Press also denied the initial report of shut downs via Twitter.

"Cellphone problems in Boston are NOT due to an intentional shutdown," Svensson wrote about thirty minutes following the initial report.

BPL: FCC Again Denies ARRL's Petition in BPL Proceeding

On April 16, the FCC issued a Second Memorandum Opinion and Order, denying the ARRL's December 2011 Petition for Reconsideration that sought reconsideration of the FCC's Second Report and Order, "fundamentally affirm[ing]" its rules for Access Broadband over Power Line (Access BPL) systems. In denying the ARRL's Petition, the FCC noted that the Petition "[did] not raise new arguments based on new information in the record or on the Commission's new analysis of limited points as directed by the Court, nor does it demonstrate any errors or omissions in the Commission's previous decisions," and that its previous rulings "strike an appropriate balance between the dual objectives of providing for Access BPL technology — which has potential applications for broadband and Smart Grid uses — while protecting incumbent radio services against harmful interference."

bpl The ARRL made 14 principal points in its Petition, each of which was aimed at urging the FCC to enact additional rules that would permit BPL systems to operate without the severe interference potential inherent in BPL technology. The ARRL argued that the current rules do not address this severe interference potential, which was manifested in every deployment of BPL in which the safeguards urged by the ARRL were absent. The FCC dismissed all of the ARRL's arguments, claiming that the ARRL "did not submit any new information," made "no new argument" or that it had, in the Commission's view, failed to make its point.

ARRL General Counsel Chris Imlay, W3KD, said that full time, mandatory notching of amateur bands to a notch depth not less than 25 dB was "the least that the FCC should have required in its rules, because interference prevention is possible; post-hoc remediation is not. In this instance, the FCC has not acted responsibly in its stewardship of the MF and HF radio spectrum. The ARRL will continue to vigilantly guard against the abuse and pollution of the radio spectrum in the use of BPL technology on a case-by-case basis as necessary, wherever necessary."
